1. Definitions

These general terms and conditions apply to all orders and shipments from Upets.nl, Gooiland 15, 1948RC Beverwijk, (Company of S&W Import Export BV) and its customers via the online shop www.upets.nl

2. Order process, conclusion of agreements, limited quantity

Order process

Upets.nl offers its customers an offer for things concerning dogs and cats. By clicking on the products or product descriptions, the customer can navigate to the product details, for example details related to the product design, or taste. The product is placed in a virtual shopping cart by indicating the desired quantity and then clicking the shopping cart button.

By clicking on the “shopping cart” icon in the top right corner of the website, the customer can navigate to an overview of products in the virtual shopping cart and make adjustments where necessary.

If the customer does not wish to add further products to the online shopping cart, the processing of the order can be continued via the “Send order” button. Registered customers can enter their name and password here to automatically use their saved information for this order. If a customer is not yet registered, he can also register here or complete the order without registering. In this case, the customer must fill in the address and order information on the next page.

By clicking on the icon “account”, the customer will be taken to the “Dashboard”. Here the customer has an overview of his or her order with details about the price (including VAT) and details about shipping and costs.

The order is placed by clicking on the button “Place order”. This means that a binding order has been placed.

Concluding agreements

The images of the range in the online shop are illustrative and intended to give the customer an idea of the product; these are not binding. The customer makes a binding order by entering into a purchase agreement when completing the ordering process by clicking on the “Place Order” button. The customer then automatically receives a confirmation and a receipt of the order by e-mail (order confirmation). This order confirmation is not related to the acceptance of the order. The agreement with zooplus is only confirmed if zooplus sends the ordered products to the customer and the customer receives an email with confirmation (shipping confirmation).

Concluding agreements in advance

Deviating from 2.b. With the choice of prepayment, a contract is already concluded when the payment information is sent by Upets.nl. This payment information is sent to the customer within 24 hours of placing the order. The order confirmation does not contain payment information. In case of prepayment, the amount of the account is due from the moment of receipt of the payment information and must be paid within 7 days by transferring the amount to one of the under 8.e. said accounts. The date on which the amount is credited to our account is leading. If after 7 days no payment on one of the under 8.e. said accounts is observed, the customer's order is automatically canceled.

Limited amount

The products on offer are only sold in normal household quantities and only to persons of an age in which they are able to enter into a legal transaction.

3.  Prices and shipping costs

Prices

All prices include VAT and other price elements; these prices must be increased with any applicable shipping charges.

Shipping costs

Upets.nl delivers from a minimum order value of EUR 14 (excluding shipping costs). In the Netherlands, orders are free of postage from an order value of EUR 30.00. In cases of an order value of less than EUR 30.00, Upets.nl charges shipping costs of EUR 5.75. The shipping costs to Belgium, Luxembourg and Germany are € 9.00. Customers do not pay additional shipping costs if a shipment has to be divided into several parts for technical or logistical reasons.

4. Shipment

Unless stated otherwise in the order, the delivery time is 1-2 days within the Netherlands. The delivery time is between 2 and 4 days in Belgium, Luxembourg and Germany.

In the event that the ordered products are not in stock, Upets.nl can, at its own expense, deliver the order in parts, given that this is acceptable to the customer.

In the event that Upets.nl is unable to deliver, because the ordered products have not been delivered to Upets.nl by its own suppliers, Upets.nl may withdraw from the agreement without fault. In such a case Upets.nl will inform the customer and offer a comparable alternative. If a comparable product is also not available or if the customer does not want to order the alternative, Upets.nl will refund the amount paid to the customer.

In the event of damage during shipment, contact customer service@upets.nl. As a result, Upets.nl has the option to file a complaint with the delivery person about the damage suffered. If the customer is unable to provide information about the damage incurred in transit, this will not affect the customer's warranty rights

5. Retention of title

The goods remain the property of Upets.nl until payment has been made. For the transfer of ownership, pledging, processing or editing is not permitted without the permission of Upets.nl.

6. Right of withdrawal

Private customers (consumers) have the right to cancel within fourteen days. A consumer is a natural person who enters into a legal transaction with an intention that cannot be attributed to their commercial or independent professional activity. The following regulations apply to cancellation and the exceptions of cancellation rights. If customers have any other questions about cancellation, they can contact Upets.nl customer service.

Cancellation instructions

You have the right to cancel the contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or another third party appointed by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Upets.nl, Gooiland 15, 1948RC Beverwijk, The Netherlands) by means of an unambiguous statement (for example a letter or e-mail) about your cancellation of the agreement.

In order to enforce the right of withdrawal, it is important that you submit the notice about canceling the agreement before the end of the term.

Consequence of withdrawal

If you cancel the agreement, we will refund all payments we have received from you, including shipping costs (with the exception of additional costs, which arise from the fact that you have chosen a different type of delivery than the most advantageous standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we have received your notification of withdrawal from the agreement. For this refund we will use the same payment method (when possible) that you used in the original transaction, unless otherwise expressly agreed with you. Under no circumstances will you be charged for the reimbursement. We can refuse the refund until we have received the goods back or until you have shown that you have returned the goods. Depending on which of these two happens first.

You have the goods to us quickly and in any case no later than fourteen days from the day you informed us of the withdrawal from the contract.

Upets.nl bears the costs for returning the goods.

You are responsible for possible loss of value of the goods if this loss of value is attributable to you. You may of course inspect the product for properties and use.

End of the withdrawal conditions

Exceptions to the right of withdrawal

The right of withdrawal does not apply in the case of the shipment of goods that:

are not pre-produced and the individual selection of whether the determination by the consumer is important for the production of the goods, or goods that are clearly aimed at the personal wishes of the consumer. Goods that spoil quickly or goods with a short sell-by date.

not if the package has already been opened.

are inseparably mixed with other goods after delivery.

7. Warranty and liability

The legal warranty applies.

Veterinary diet food should only be used on the advice of a veterinarian and should be accompanied by regular veterinary supervision. The vet should be visited regularly (every 6 months) while using specialty food, and if your pet's condition deteriorates, a vet should be visited immediately. upets.nl is not liable for the consequences of inappropriate or unnecessary use of veterinary feed.

8. Payment methods and credit notes

Payment methods

Goods can be paid with iDeal, on account or in advance. Upets.nl has the right to accept certain payment methods in individual cases or depending on the delivery method chosen by the customer. Payment by cash or check is not possible.

Payment on account

In case of payment on account, the customer will pay the amount within 14 days after the goods have been delivered. This concerns the date of receipt of the payment at Upets.nl.

Prepayment

With prepayment, the customer transfers the total amount of the order immediately after ordering. An order is reserved for the customer for seven days. After payment has been received by Upets.nl, the order is automatically sent to the customer immediately. We also offer the option to pay directly via IDEAL.

Payment arrears

If the customer is in arrears, the purchase amount will accrue interest during the arrears of 5 percentage points above the ECB base loan rate. If the customer is not a consumer, the interest rate is 8 percentage points above the base loan rate.

Credit notes

In the case of redemption of credit notes, the specific, valid redemption conditions, minimum order quantity and period of validity, etc. must be observed. The corresponding information can be found on the credit notes. In any case, only one credit note or one order / customer discount can be used per purchase. Payment in cash or settlement with previous orders are not possible. Reselling is prohibited.

Transaction costs

No transaction costs will be charged.

9.  Privacy

Upets.nl takes the protection of the privacy of customers very seriously.

11. Final provisions

Should provisions of these terms of use be or become invalid or inapplicable, the validity or enforceability of the other provisions of these terms of use will not be affected. Dutch law applies when European law is not sufficient for the matter. This choice of law applies only insofar as the protection granted is not revoked by mandatory provisions of the law of the country in which the customer is located at the time of his order. ”
